Civil procedure code changes expected

New significant amendments of The Civil Procedure Code are currently under discussion in the Bulgarian Parliament.
Generally they  are expected to effect  the following areas
Notifications for court documents, enforcement procedures and Supreme Court appeal options.
The current procedure for notification of parties about undergoing legal procedures against them will be complicated by implementing a list of strict requirements that the Court notification service should execute in order to consider  a party as "notified" although actually no one   was found on the address.
The possibility to access Supreme Court civil or commerce case review will be eased in correspondence of the current legislation. As for now it is very rare and difficult  pass a complaint against the Appellate or District Court decision  over the  extremely high requirement of the law for such kind  of procedure. The logic for that was the idea to make the civil jurisdiction procedures faster and efficient . In future most likely cases above a certain threshold (BGN 5000, amounting to EUR 2500, for civil cases and BGN 20,000, amounting to EUR 10,000, for commercial cases) to reach the Court.
Expectedly the Banks will be limited to use their own issued debt amount financial statements to get an enforcement execution note without standard case procedure.
A totally new d absolute 10-year  period for claims against natural persons shall be included that will more easily absolve debtors it may expire even while there is a pending court procedure regarding the claim.
Changes  are expected  to occur in the process   setting asset value   in  the enforcement procedures and al the bid price for real estate properties that are auctioned by enforcement agents.

Changes in bulgarian Traffic Act

Since  10.07.2017 new changes in the Bulgarian Traffic Act have been in power. The most significant of them are related to the ability of the Bulgarian traffic police authority to register over speed limit breech using mobile speed camera with no  warning signs for this in advance.
Although , according to  “Ivanova and Hristozov Law Firm” this amendment  contradicts with higher priority legal act , probably it will take some time  for the corresponding juridical procedures upon particular cases to clarify how legal this change is.
